Is there a charge for setting up my account?
No. There is never a set up fee, monthly fee or minimum requirement. You pay only for what you need when you need it.
How long does it take to set up my account?
We offer same day account set up. Generally, you can be submitting requests within a couple hours of returning your client agreement.
Do I have to sign a contract?
No, there are no contracts. You will sign a client agreement at set up indicating you will obtain and retain release forms, abide by the Fair Credit Reporting Act, and use your account and any information obtained for the purpose intended.
How will I submit a request?
All reports are submitted and retrieved online.
What is the Fair Credit Reporting Act (FCRA)?
The FCRA spells out the legal obligations of an employer when using information from a consumer reporting agency for the purposes of hiring, retaining and promoting an employee. It very specifically tells you what steps you must take, what information you can use, and how you can use it.

Do I have to disclose to potential or current employees that a consumer report will be obtained?
You must notify new hire applicants in writing that you intend to request a consumer report. This notice must be disclosed in a document used solely for this purpose and the applicant must give you written authorization before requesting the report. (The trucking industry has special procedures).
If you have given current employees a written notice in a document consisting solely of the disclosure in the past and that notice stated consumer reports may be obtained throughout the duration of their employment, and they have given you written authorization for such, you are not obligated to give them further notice when obtaining consumer reports for the purposed of retention or promotion.

What are my obligations if I decide not to hire an individual based on information obtained by a consumer reporting agency (CRA)?
If any information included in the consumer report, whether positive or negative, influences your decision not to hire, retain or promote an individual, you must provide that individual with a pre-adverse action disclosure. (see example below). A pre-adverse action disclosure will include a copy of the consumer report and 'A Summary of Your Rights Under the Fair Credit Reporting Act' from the FTC. This summary is included with every report you will receive from Employ Safe Technologies, Inc.
If you decide not to hire, retain or promote an individual based on information obtained from a consumer reporting agency and you have provided them with a pre-adverse action disclosure, you may then notify them the action has been taken in an adverse action notice (see example below). This notice will consist of the name, address and phone number of the CRA that supplied the report, a statement that the CRA did not make the decision to take adverse action and cannot provide the reasons for it, and a notice that the individual has the right to dispute the accuracy or completeness of any information obtained as well as request an additional free consumer report from the CRA within 60 days.
